
Code of Conduct and Waiver
1. Participation & Assumption of Risk
I, on behalf of myself and, where applicable, my child or minor participant, agree to the terms of this Agreement in consideration of being permitted to participate in karate classes, training, seminars, examinations, demonstrations, tournaments, and other activities provided or organized by Shitoryu Karate Manitoba (the “School”). I understand that karate is a physical martial art and involves inherent risks, including accidental contact, falls, sprains, strains, fractures, concussion, serious injury, disability, or death. I voluntarily accept and assume all risks associated with participation in the School’s activities, whether at the School, another facility, or during off‑site activities. I confirm that I am responsible for determining whether I or my child is physically capable of participating and agree to inform the instructor of any injury, medical condition, or limitation that may affect safe participation. Pictures and videos may be taken during classes and may be posted on social media platforms (including, but not limited to, Facebook and Instagram). We will ask whether you and/or your child consent to being included in such media. Students and parents are expected to abide by the Shitoryu Karate Manitoba Code of Conduct. Failure to comply may result in disciplinary action, including removal from class or the program, at the instructor’s discretion, with no refund. I acknowledge receiving and understanding the Shitoryu Karate Manitoba Code of Conduct.
2. Waiver, Release & Covenant Not to Sue
To the fullest extent permitted by Manitoba law, I release and hold harmless Shitoryu Karate Manitoba, its owner, instructors, employees, contractors, volunteers, agents, and representatives (the “Released Parties”) from any claims, demands, actions, damages, losses, costs, or liabilities arising from or relating to my participation, or my child’s participation, in the School’s activities. This includes claims relating to injury, illness, disability, death, or property loss, including those arising from other participants or the use of facilities or equipment, except where liability cannot legally be waived. I agree that I will not commence or maintain any lawsuit, claim, or proceeding against any Released Party for any matter covered by this Agreement. I understand that by signing this Agreement, I am voluntarily giving up substantial legal rights.
3. Indemnity
To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims, losses, damages, costs, and reasonable legal expenses arising from my conduct or breach of this Agreement.
4. Code of Conduct & Class Behaviour
All students, parents, guardians, and visitors must demonstrate respect, discipline, self‑control, and appropriate martial arts etiquette toward instructors, fellow students, parents, and visitors. Participants must follow instructor directions, adhere to safety rules, use appropriate control during training and sparring, and avoid behaviour that may endanger themselves or others. Bullying, harassment, threats, fighting, intentional injury, discrimination, intimidation, abusive behaviour, or reckless conduct will not be tolerated.
If a participant or their parent/guardian behaves inappropriately, disrupts class, refuses to follow instructions, or endangers others, the instructor may remove the participant from class for the remainder of the session or permanently remove them from the program without refund. Repeated behavioural or safety violations may result in suspension or permanent removal without refund. Serious misconduct or behaviour posing immediate danger may result in immediate removal or suspension without prior warnings. Parents/guardians will be contacted when appropriate, especially for minor participants.
5. Emergency Medical Authorization
In the event of an emergency, I authorize Shitoryu Karate Manitoba and its representatives to obtain reasonable emergency medical assistance for myself or my child when I cannot provide consent. I understand that any resulting medical expenses are my responsibility.
6. Minors
If the participant is under 18 years of age, I confirm that I am the participant’s parent or legal guardian and have the authority to provide this consent. I agree to these terms on behalf of myself and, to the fullest extent permitted by law, on behalf of the minor participant.
7. Class / Session Fee
I agree to keep payments in good standing for the full duration of this contract. I understand that all class/session fees are non‑refundable and non‑transferable. I accept full responsibility for payment of all fees associated with this session.
8. Severability & Governing Law
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue to apply to the fullest extent permitted by law. This Agreement is governed by the laws of the Province of Manitoba and the applicable laws of Canada.
9. Acknowledgement & Signature
I confirm that I have read and understood this Agreement, understand the risks of karate training, understand the Code of Conduct and its consequences, have had the opportunity to ask questions, and voluntarily agree to all terms contained herein.
